Client Profile: Marko is a Ukrainian National of working age who was given permission to live in the UK along with his wife after fleeing the war……….. 

Reason client needs advice: Marko is a Ukrainian National of working age who was given permission to live in the UK along with his wife after fleeing the war. Marko has a significant health condition which does impact on his daily life.   Marko needed help applying for Personal Independence Payment (PIP) which our Benefit Specialist assisted him with. 

What we have done to help the client:

The PIP application was submitted to the Department of Work and Pensions (DWP). This application was refused 10 days later, with the DWP advising Marko that he only scored 2 points for Daily Living and no points for Mobility. This was despite comprehensive medical evidence supporting his claim. A Mandatory Reconsideration Notice (MRN) was issued. Unfortunately, DWP claimed they had not received the MRN despite our proof of a recorded delivery receipt.   

The DWP issued directions to strike out the case due to lacking a MRN. Our Benefit Specialist opposed this attempt and appealed to His Majesty’s Courts and Tribunal Service (HMCTS). Due to this appeal, HMCTS decided not to proceed with the strikeout. 

One month later our Benefit Specialist received a call from a manager at the DWP who asked if Marko would settle the claim out of court, to which Marko agreed.  

Outcome:

Marko received a backdated payment of £7,400 and was awarded £103.35 which is the standard rate for daily living and mobility for 77 weeks. 

Marko is now better off by £15,373.35 .
