Client Profile: Andy is in his late 40’s, married and lives with his wife in a 2 bedroomed local authority property. Andy has a long history of illnesses dating back at least 15 years, his ailments are both mental and physical.
Reason client needs advice: Andy contacted Citizens Advice Harlow because his Personal Independence Payment (PIP) had been stopped by the Department of Working Pensions (DWP). Andy was extremely distressed by this and wanted to know what could be done in the circumstances. The decision letter stated he was awarded zero points for mobility and the daily living element of PIP.
What we have done to help the client:
Our Benefits Specialist immediately launched a Mandatory Reconsideration (MR), unfortunately, the original decision was upheld. Consequently, our Benefits Specialist appealed this decision and sent the First Tier Tribunal (FtT) a submission on behalf of Andy.
Outcome:
The FtT disagreed with the assessment and awarded Andy the enhanced rate for both elements of PIP for a period of 5 years.
Outcome: PIP award for 5 years - £48,102.30.
